Design Registration To
apply for an industrial design registration, the applicant shall
submit an application form with application fee and enclose the
following documents: 1.
The application form: Industrial Design Form 1 2.
Six representations of the article to which the industrial design
is applied 3.
A statement of novelty in respect of the industrial design 4.
Assignment form In
the case that the applicant is not the designer, the right to apply
for an industrial design has to be assigned. For the effective
legality in Malaysia, the assignment of the right to apply for an
industrial design is done by way of a deed in writing and signed by
the assignor and the assignee. 5.
Power of Attorney In
the case that the applicant is the foreigner. It is necessary to
appoint a Malaysian agent and must be registered with the Industrial
Designs Registration Office (IDRO) in Malaysia as well. The appointment
of an agent is done using ID Form 9. Remarks: 1.
In the case of filing the first corresponding application
outside the kingdom of Malaysia using priority claim, the patent
application of the industrial design in Malaysia shall be filed within
six months since the date of the first filing of the industrial design
application abroad. For claiming the first filing date, the applicant
must make a declaration claiming priority. 2.
All official forms, documentation and correspondence must be in
English or Bahasa Malaysia. As well as, any extraneous documents which
are used to support the application or which are required by the
Registrar, if in a language other than English or Bahasa Malaysia,
must be translated.
