1. How to Get a Patent in Thailand
The Thai patent application shall proceed as follows: 1. The applicant shall submit an application form with application fee. He shall also enclose the following documents: 1.1.Thai patent application form: Sor-Por/Sor-Por/001-Kor form 1.2. A
description of invention/design

1.7. Power of attorney: 2.1.Under the formality check where the patent application is incorrect ,the applicant must be requested according to Sor-Por/Sor-Por/002-Kor form with application fee. The applicant shall amend the application formality within 90 days. 2.2. When the formality of application for patent is correct, the competent officer shall notify the applicant of paying the publication fee. 2.3. After publication of the application has been made, the applicant shall request for the examination of invention patent with the Sor-Por./003-Kor form within 5 years since the publication date. In case there is an opposition, the applicant shall make a counter-statement within 90 days of receipt of the opposition. 2.4. When the Director-General has considered the examination report acceptable, and no opposition has been filed, the competent officer shall notify the applicant of paying the fee for the grant of the patent within 60 days from the date on which such notice is received. 2.5. After the fee has been paid, the Director-General shall order the patent to be registered and granted to the applicant. Remark: 1. In case of filing the first corresponding application outside the kingdom , the patent application of the invention and the patent application of the design in Thailand shall be filed within twelve months and six months respectively since the date of filing the said patent application overseas for the first time, in case of members of WTO. In addition, the priority certificate documents for the patent application of invention shall be submitted within 16 months from the date of filing the said patent application overseas for the first time. In contrast, there is no time constraint for the patent application of design. However, the certified documents shall be submitted before the publication date. 2. All documents in foreign language must be translated in Thai language. |
