How to get a patent in Malaysia
Procedure of Patent Registration
(Invention)
Invention Application The
Malaysia invention application shall proceed as follows: 1. The
applicant shall submit an application form with application fee. He
shall enclose the following documents: 1.1
A request for the grant of a Malaysia patent invention: Form 1 1.2
A description of invention 1.3
Claim(s) 1.4
Drawing(s); if any 1.5
An abstract 1.6
Assignment form In
the case that the applicant is not the inventor, the right to apply
for a patent invention has to be assigned. For the effective
legality in Malaysia, the assignment of the right to apply for a
patent invention must be required in writing and shall require the
signatures of both assignor and assignee. 1.7
Power of Attorney In
the case that the applicant is the foreigner. It is necessary to
appoint the agent who has residence in Malaysia and must be registered
with the Patent Registration Office (PRO) in Malaysia as well. The
appointment shall require the authorization statement and the
signature of the applicant using the Patents Form No.17. Remarks:
1. In the case of filing the first corresponding application
outside the kingdom of Malaysia using priority claim, the patent
application of the invention in Malaysia shall be filed within
twelve months since the date of the first filing of the patent
application abroad. For claiming the first filing date, the applicant
must make a declaration claiming priority. 2.
All official forms, documentation and correspondence must be in
English or Bahasa Malaysia. Also, if supporting documents are in
a language other than English or Bahasa Malaysia, they must be
translated.
